| Commission-only sales work; rules and practice. [message #374028] |

A young relative has recently embarked on a sales career on a
commission-only basis with a UK company and I am looking for sources
relative particularly to the legal and taxation aspects of this. I have
tried the IR site but failed to think of a search string that worked,
and likewise with Google.
No doubt he will be pointed in the right direction by the company
and/or an accountant when he gets round finding one but it would be
good in the meantime to explore the various aspects of what I suppose
is a form of self-employment.

'Commission Only' as such isnt really an HMR&C topic, or even much of a
legal one and I am not sure what you are looking for. Do you really mean
that he is 'self employed'?

I think he does, jb.
I was going to tell him that comission only employment was
now illegal and then I guessed that the contract was likely to be
SE.
I am concerned at what the son may be selling though.
Some of these comission only jobs are at the margin of what
people buy. I hope that the son is sure of the market he is
entering.

Thanks for the responses.
Not wishing to be specific he is selling a common type of home
refurbishment package, and yes it would be on a self employed basis. I
really don't know what his chances of success are but at least he is
learning something new and if he turns out to be no good at it he will
by out fast!
The sort of information I am looking for would include the IR rules on
self employment as applied to this type of work and how in practice
these are complied with. AIUI doing work for one company can be
construed as concealed employment and this leads me to suspect that
there may be a special set of rules for commission-only sales people.
Other examples would be accounting practices, and information, hints,
tips etc from people who have experience of this type of work.

If you want a sensible answer you will have to be a bit specific. It
must be one particular industry or firm, so name it and people can tell
you how the industry works.
