| Filing Income Tax Returns and PAYE [message #375843] |

Dear All,
Can I ask you a question regarding filing of IT while on PAYE please?
Previously I used to file my income tax returns because of my salary
bracket.
Then I joined a company taking a salary cut in DEC 2003 and therefore
got onto the PAYE
scheme . And I'm on the PAYE scheme now too, since then..
I Joined PAYE scheme Dec 2003 and filed my returns for Apr 2003 to Apr
2004 in Jul 2004.
Sometime after that i was sent a SA-210 short tax return form and I
think I didn't
send this in because I was already on PAYE. I might have clarified this
with IR on
the phone though, I honestly can't remember.
Now I got a call today from the IR saying I need to file my returns for
year ending 2005.
Do I have to do this? I thought I didn't have to, because as I said
I've been on PAYE since
end of 2003. Please help, Thanks

The rule is simple, if you get a return you must complete it and
send it back (by the due date).
If you think that you no longer qualify for a return every year
you will have to ask them not to send them in future, they may
decide to gnore this request.

For added flavour, they might send you a letter saying "We don't want
you fill in a return" and follow it up 3 months later with a return....
The IR and & I have been exchanging the same 500 quid refund and demand
on alternate years for the past 5 years - next January it's their turn
to pay me....

Yes

That is irrelevant. E.g. you may be on PAYE on one job, but also be a
self employed taxi driver and a landlord. HMR&C dont know this unless
they ask you. Being on PAYE does not absolve you from completing a
return if asked to do so.

You're always allowed to ask HMRC. Having a bad memory doesn't have to
be combined with a lack of initiative.

No, you can refuse on the grounds that your lack of knowledge absolves
you from HMRC advising you what to do.
I'm only joking - if you're asked to submit the return just do it
immediately before your memory takes over.
