| GoDebt debt collection [message #386504] |

I recently received a letter from GoDebt demanding payment for a loan
that I have absolutely no knowledge of.
The loan was taken out on a company I was a director of 6 months AFTER
I legally dissolved the company. The companies bank accounts were not
used (they had been closed), nor were any of my personal details.
Where do I stand legally on this ? I assume that ultimately I will not
be responsible for payment but is the onus on me to proove that I am
not responsible ? or on them to proove it was something to do with me ?
Thanks in advance,
Matt

Are you sure that the debt demand is for a genuine loan or is someone trying
to scam you.
Ask for full disclosure on the loan details, including what bank the loan
was paid into. It sounds a bit suspicious that neither the loan company or
the bank checked that the ltd company actually existed.
Make sure you report the incident to the police to cover your back.

Did they supply any details which, had you in fact been responsible,
would have jogged your memory? Did they say they were collecting on
behalf of your lender or that they had bought the debt and are now
collecting on their own behalf?

On bedrock, the firmness of which Gibraltar can only dream of.

Of course not. [by the way, although there are two 'o's in "proof",
there is only one in "prove"]

The onus of proof is always on the creditor. You can't just have
any Tom, Dick, or Harry come along and cause you grief just by some
wild fabricated claim that you owe them something.
Just tell them to f (scratch that) Just write to them politely and
succinctly and tell them you have no idea what loan they're talking
about and they're welcome to supply further details but that it's
unlikely that any details they might be minded to provide would
convince you that you owed them anything. Then if they write back
with more details, and you still don't remember, tell them so and
say you now consider the matter closed.
Then if they contact you again warn them that you will report them
for harrassment if they don't f (I mean desist). Then if they persist
report them to the police.

Usually, in case you are ignoring their demands, debt collectors will pass
your details to a solicitor company who will threaten you with the small
claims court. Just meet them in the court, with all you documents handy.
If you feel sympathetic to them you may probably write a letter stating
the facts and iviting them to further actions. Ah, by not paying you are
inviting them anyway.
Under no circumstances ever give them your home or mobile phone number.
