Hi,

When I filled my tax return for 2004/2005 I noticed that my benefits in
kind was much higher than the previous year. I have asked my employer
about this but they are saying that they might refuse to change the
p11d as it was issued such a long time ago (I filled in the tax return
at the latest possible date and didnt really take any notice of the
p11d until then).

It seems like there must be an error - 3100 instead of 1400 the
previous year. To complicate further I have decided to move to another
company. Would like to know what avenues are open to me now:

1. Is there a legal obligation for the employer to check/amend my p11d?
2. Can I edit my tax return to declare a different figure than what is
supplied on the p11d?
3. Should I give up and instead fill in my 05/06 return as soon as
possible?

I have just altered p14s and p35s for the year 2001/2002. So the tax office
will def accept changes.

However in the process they lost all our existing paperwork, apparently one
of the case workers has probably put the file under someone else's section.
Ho Hum......

I complete my own P11D for a small company and a few years ago I paid
some NICs in error on some milage. I wrote to them later to advise them
of my mistake and the NICs were repaid so they will accept changes up
to a point.

Thanks for your replies.

In this case I think my current employer has decided that they dont
really care about amending the p11d (as I am leaving), so although I
realise hmrc will accept changes, I wondered if they would somehow
accept the fact that I dont believe the figure is correct, even if
changing it is not in my hands....

Talk to HMRC, they are normally very helpfull. Except when they lose all
your records which can be annoying ....

Thanks,

I had to speak to hmrc anyway and I asked this question to them. Their
reply was that I should try to resove this with my employer, though
they would be prepared to listen to my case if my employer refuse to
cooperate.
