Urgent ..Please help...

I am writing regarding a home in the Bay Area, CA.

My sister bought it NEW from the home builders about 8 years ago.

There is a leak in the pipes (bath tub area) inside the walls and is
dripping to the first floor. This could be serious and cost a lot of
money to repair.

Can anyone pls tell me what is the warranty for for such pipe leaks ?

We tried recaulking the bath tub ...but it did not help.

Is the builder responsible for this ?

What is the law with respect to home builders and plumbing/leaks/
related warranties ? is it 10 years ?

In speaking with the HomeBuilders they brushed us off ...saying the
warranty is only a year or so.

Do we stand on legally strong grounds ?

It depends on a lot of factors. First is your contract with the
builder. Second is state law. Next, if the pipes themselves
are leaking (and not the connections between pipes), then
there may be some warranty on the pipes. Then again, if you
have water problems, that may void any warranty if you do not
have a water treatment system. There are far too many factors
to consider in a USENET posting.

If pipes are leaking, caulk is not going to do anything for you.

Responsible for causing the probem? Maybe.
Responsible for paying for it? Not likely.

It all depends. You need to talk with an attorney in your
area to review your contract, your warranties, and your
state law.

They are probably right.

It really concerns me here that you have a typical home owner's
problem, and it has been nearly a decade, yet your first
thought is taking legal action. That is a hell of a way
to think. Your first though should have been how do I fix
this so I don't cause yet more damage or allow mold to grow.

Most building codes require that there be an access panel
to get at the pipes behind the bath tub. In reality, this
might be an easy fix. No need to spend thousands on legal
fees when $200 might do the trick. How about getting a
licensed plumber to take a look at it and get an estimate
before starting to threaten lawsuits?
