QUESTION about buying old houses?
am 23.01.2006 07:31:27 von The Space Boss
I'm looking at some houses that were built between 1914 and 1946. Would
there be any potential legal problems with tenants in reguards to:
* Lead in the plumbing (some of it is original from the 1914 house
even)
* Lead paint on the walls
* Asbestos in or around the home?
Are any of these to be concerned of? Thanks.

No laws that I know of, but by now, any original pipes from
before WWII would likely be so plugged up that they would have
been replaced by now. If the house hasn't been retrofitted with
copper or the new PEX plumbing, figure on doing that as part of
your deal.

There is a huge body of both case law and administrative procedure
on lead paint. Basically, you need to disclose to each prospective
tenant what the exact status of your lead paint is. That can be
anything from none, lots, to unknown.

Asbestos has a large body of law, but only for the handling
of asbestos and the disposal of asbestos. I don't know that
you need to notify tenants. Where asbestos becomes a problem
is if you have some, and you want to make a repair or change.
You may have to have a specialized asbestos mitigation team,
which could hamper your ability to get things done, and cost
big $$$.
